Please read these Terms & Conditions before placing an order with Alva Fern.
These Terms apply to your use of the Alva Fern website and to purchases from Alva Fern Pty Ltd. Please note:
- 1Current gift boxes in our Shop are one-off purchases; ordering one does not start a subscription.
- 2You must have the capacity and authority to place an order.
- 3You must comply with applicable laws when using our website.
We may update these Terms by publishing a revised version on our website. Changes do not alter the terms of orders already placed. Nothing in these Terms limits rights that cannot be excluded under Australian Consumer Law.
Placing an Order & Payment
You can select a gift box from our Shop and place a one-off order through checkout. Please review the product, price and delivery details before submitting your order. Payment is processed using the options presented at checkout.
Orders are subject to availability and acceptance. If we cannot fulfil an order as placed, or identify a material error in its price or product information, we'll contact you to discuss the issue before proceeding with a change to your order. We won't automatically substitute another product.
We may conduct fraud checks where necessary. Nothing in this section limits your rights under Australian Consumer Law.
Prices & Product Information
- All prices are quoted in Australian Dollars (AUD). Gift-box prices include standard Australia-wide delivery.
- Prices displayed on the website may change. Changes do not alter the price already agreed for an accepted order.
Each gift box's product page describes what is included. Photographs show the products and their presentation; colours may appear differently on different screens. These images do not override the product description or your rights if goods do not match their description.
If an exact replacement item is unavailable when resolving a problem with an order, we'll contact you to discuss an appropriate solution rather than automatically substitute another product.
Shipping & Gift Deliveries
- Gift-box prices include standard Australia-wide delivery. In-stock orders are normally dispatched within 2–3 business days.
- Delivery time after dispatch varies depending on the destination and carrier. You'll receive tracking information once your order has been dispatched.
- Gift boxes can be delivered directly to a recipient by entering their delivery address at checkout. If an address needs changing, contact us as soon as possible. Address changes cannot be guaranteed after dispatch.
- If a parcel appears delayed or lost, please contact us and we'll investigate the delivery with the carrier.
Cancellations & Change of Mind
You may cancel or change a one-off order before dispatch by contacting us. Once an order has been dispatched, we do not offer returns or refunds simply for change of mind.
This does not affect your rights under Australian Consumer Law.
Faulty, Damaged or Incorrect Goods
If an order or item is faulty, damaged or incorrect, contact us at info@alvafern.com.au with your order details and, where relevant, photographs so we can assess the issue. For an item that arrives damaged, please include photographs of the item and its packaging.
The remedy depends on the nature of the problem and your rights under Australian Consumer Law. For a major failure, you may choose a refund or replacement. For a minor problem, we may offer a repair within a reasonable time; if it cannot be resolved, other remedies may apply.
Please contact us before returning anything. Where a return is required in connection with an eligible Australian Consumer Law remedy, we'll provide appropriate return instructions. Approved refunds are returned to the original payment method; the time for funds to appear may depend on your bank or payment provider.
Consumer Guarantees & Manufacturer Warranties
Products may also carry a manufacturer's warranty. Any such warranty is separate from, and does not replace, the consumer guarantees under Australian Consumer Law or our obligations as the seller. Please contact Alva Fern if there is a problem with something you purchased from us.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, restricted or modified, including rights under Australian Consumer Law.
Website Use & Liability
You must not misuse the website, interfere with its operation or use its content unlawfully. We may restrict access to the website where necessary to address misuse or security concerns, without affecting rights relating to an order already placed.
Website content may occasionally contain errors or be unavailable, and third-party websites are outside our control. To the extent permitted by law, we are not responsible for losses arising solely from interruptions to this website or third-party websites outside our control.
This does not exclude or limit any liability or consumer rights that cannot legally be excluded or limited, including for faulty goods or a failure to meet consumer guarantees.
Previous Subscription Purchases
Subscription products previously purchased were separate from current Shop gift-box orders. The plan details and billing options shown when a previous subscription was purchased relate to that purchase; they do not make current one-off gift-box orders recurring orders. Intellectual Property
Content on this website is owned by Alva Fern Pty Ltd or used with permission, as applicable. This includes:
- Website design and database
- Logos, branding, images, illustrations, marketing material
- Text, graphics, and product descriptions
Except as permitted by law, you may not reproduce or distribute our content for commercial purposes without our prior written consent.
